TRAVEL WITH MICH,  TERMS & CONDITIONS, LIABILITY WAIVER & POLICIES

Welcome to Travel With Mich (“Travel With Mich,” “we,” “our,” or “us”).

By booking, reserving, purchasing, participating in, or using any service offered by Travel With Mich, you acknowledge that you have read, understood, and agreed to the following Terms & Conditions.

These terms apply to all transportation services, airport transfers, cruise shore excursions, tours, nightlife experiences, private charters, concierge services, sightseeing activities, custom itineraries, and experiences coordinated or operated by Travel With Mich throughout Jamaica.

1. COMPANY ROLE

Travel With Mich operates as a private transportation provider, travel concierge, and experience coordination company.

Certain excursions, tours, water activities, nightlife experiences, boats, charters, attractions, photographers, restaurants, and adventure activities may be operated by independent third-party suppliers or operators.

Travel With Mich may act as a booking facilitator and coordinator for these services.

Independent operators maintain their own:
– licenses
– insurance
– safety standards
– operational control
– staff
– equipment

Travel With Mich shall not be held liable for acts, omissions, delays, injuries, damages, closures, cancellations, or operational failures caused by third-party providers.

2. BOOKINGS & RESERVATIONS

All bookings are subject to availability and are not confirmed until payment or deposit is received.

Travel With Mich primarily operates on a pre-booking basis.

Clients are responsible for providing accurate:
– flight details
– cruise information
– hotel or Airbnb address
– group size
– phone number
– email address
– participant information

Failure to provide accurate information may result in delays, missed services, additional charges, or cancellation of services.

3. PAYMENT POLICY

A minimum deposit is generally required to secure reservations unless otherwise stated.

The remaining balance is typically due prior to arrival or service commencement.

Accepted payment methods:
– Visa
– Mastercard

We do not currently accept:
– American Express
– Discover

Online payments may include processing or banking fees charged by third-party payment processors.

Travel With Mich reserves the right to cancel unpaid reservations.

4. FRAUD & CHARGEBACK POLICY

By submitting payment, the cardholder confirms they are authorized to use the payment method provided.

Travel With Mich reserves the right to:
– verify payment information
– request identification
– decline suspicious transactions
– cancel bookings suspected of fraud

Clients agree not to initiate fraudulent or unjustified chargebacks for:
– completed services
– reserved services
– customized itineraries
– agreed cancellation terms
– non-refundable deposits

Travel With Mich reserves the right to dispute chargebacks using supporting documentation including:
– invoices
– payment confirmations
– GPS records
– signed waivers
– itinerary confirmations
– written communications
– booking records

5. CANCELLATION & REFUND POLICY

All cancellation requests must be submitted in writing via email or WhatsApp.

Unless otherwise stated:

– Cancellations made 7–14+ days prior to the guest’s arrival date in Jamaica may be eligible for rescheduling, partial refund, or travel credit, at the discretion of Travel With Mich.

– Cancellations made less than 7 days prior to arrival in Jamaica are non-refundable.

– Once the guest has arrived on the island of Jamaica, all payments become non-refundable.

Deposits are generally non-refundable.

Nightlife reservations, VIP sections, club packages, special event bookings, customized itineraries, and third-party reservation payments are strictly non-refundable.

No refunds will be issued for:
– no-shows
– missed pickups
– late arrivals
– unused services
– voluntary withdrawal from activities
– intoxication-related removal
– missed excursions due to guest delays
– cruise itinerary changes
– flight delays causing missed activities
– weather-related discomfort where services remain operational

Approved refunds, where applicable, may take 10-20 business days depending on banking institutions and payment processors.

Travel With Mich reserves the right to determine refund eligibility based on operational costs, supplier commitments, third-party policies, and reservation expenses already incurred.

PRIVATE YACHT & CHARTER BOOKINGS POLICY

All private yacht, private boat charter, and luxury charter reservations are strictly non-refundable due to advance operational, staffing, docking, fuel, and reservation commitments.

Guests may request to reschedule their yacht or charter booking if written notice is provided at least 7 days prior to the scheduled charter date.

Rescheduling requests are:
– subject to availability
– subject to operator approval
– subject to weather and operational conditions
– limited to one reschedule unless otherwise approved

Failure to provide at least 7 days notice may result in forfeiture of all payments made.

Certain third-party yacht operators may apply additional terms, restrictions, rescheduling fees, or peak-season surcharges.

Travel With Mich is not responsible for cancellations or delays caused by:
– weather conditions
– rough sea conditions
– government restrictions
– harbor restrictions
– mechanical issues
– Coast Guard advisories
– third-party operator decisions
– force majeure events

6. RESCHEDULING POLICY

Travel With Mich aims to remain flexible while maintaining fairness to our team, drivers, partners, and third-party operators.

– Guests may reschedule their reservation once without penalty if notice is provided at least 48 hours prior to the scheduled service date and time.

– Rescheduling requests made less than 24 hours prior to the scheduled service may be treated as cancellations and may become non-refundable.

– All rescheduling requests are subject to availability, operational capacity, seasonal demand, and updated pricing or rate adjustments where applicable.

– Certain third-party operators, attractions, nightlife venues, boats, or excursions may apply their own rescheduling restrictions or fees.

– Written confirmation via email or WhatsApp is required for all itinerary modifications, rescheduling requests, or booking changes.

– Travel With Mich reserves the right to deny excessive or repeated rescheduling requests.

We strongly recommend notifying us as early as possible regarding any schedule changes to ensure the best accommodation options.

OPERATOR CANCELLATIONS

If Travel With Mich or a third-party operator cancels due to:
– safety concerns
– weather conditions
– equipment issues
– operational limitations
– supplier closures

Guests may be offered:
– a rescheduled date at no additional cost; or
– a travel credit for future services.

7. CRUISE SHORE EXCURSION POLICY

Travel With Mich specializes in private cruise shore excursions and prioritizes timely return to port.

However, guests are responsible for:
– disembarking promptly
– arriving at meeting points on time
– following schedules provided by the guide or driver

Travel With Mich shall not be held liable for missed embarkation caused by:
– guest delays
– failure to follow instructions
– immigration/customs delays
– accidents
– traffic incidents
– road closures
– police activity
– weather conditions
– unforeseen operational disruptions

Cruise itinerary changes, port cancellations, or failure of ships to dock are beyond our control.

8. TRANSPORTATION POLICY

Travel With Mich primarily provides private transportation services unless otherwise specified.

Shared transportation services operate on fixed schedules and guests must arrive at pickup points on time.

Guests who fail to appear within the stated waiting period may be considered no-shows.

Travel times in Jamaica may vary due to:
– traffic
– weather
– road conditions
– public events
– law enforcement activity
– accidents
– construction

Estimated travel times are not guaranteed.

Travel With Mich does not guarantee uninterrupted service, exact travel times, specific weather conditions, ocean conditions, attraction availability, or uninterrupted access to third-party facilities or experiences.

9. ITINERARY CHANGES & OPERATIONAL FLEXIBILITY

Travel With Mich reserves the right to:
– modify itineraries
– substitute attractions
– adjust pickup times
– alter routes
– change schedules
– cancel services
– refuse service

when necessary due to:
– safety concerns
– operational needs
– weather conditions
– supplier limitations
– government restrictions
– mechanical issues
– force majeure events

We will make reasonable efforts to provide suitable alternatives whenever possible.

10. WEATHER & FORCE MAJEURE

Certain excursions and activities may be impacted by:
– rain
– rough seas
– high winds
– flooding
– storms
– natural disasters
– government restrictions
– civil disturbances
– health emergencies

Travel With Mich shall not be liable for cancellations, delays, losses, or modifications caused by circumstances beyond our reasonable control.

11. ASSUMPTION OF RISK

Guests acknowledge that participation in tourism and adventure activities involves inherent risks.

These activities may include:
– ATV riding
– horseback riding
– rafting
– jet skiing
– parasailing
– catamaran cruises
– snorkeling
– cliff jumping
– nightlife activities
– hiking
– ocean-based activities
– road transportation

Participants voluntarily assume all risks associated with participation, including:
– injury
– illness
– drowning
– slips and falls
– collisions
– equipment failure
– negligence of third parties
– death

12. LIABILITY WAIVER

To the fullest extent permitted by law, Travel With Mich, its owners, affiliates, employees, contractors, drivers, guides, and partners shall not be held liable for:
– personal injury
– illness
– emotional distress
– property loss
– theft
– delays
– accidents
– missed flights or cruises
– weather disruptions
– third-party negligence
– death

Participation in any service or activity is voluntary and at the participant’s own risk.

13. HEALTH & MEDICAL CONDITIONS

Guests are responsible for determining whether they are physically and medically fit to participate in booked activities.

Guests should inform operators of:
– pregnancy
– heart conditions
– disabilities
– mobility limitations
– allergies
– medical conditions

Certain activities may include weight, age, or health restrictions.

PREGNANCY POLICY

For safety reasons, pregnant women are not permitted to participate in certain adventure or high-impact activities, including but not limited to:
– ATV tours
– horseback riding
– ziplining
– jet skiing
– parasailing
– rafting
– catamaran party cruises
– cliff jumping
– certain water sports and adventure excursions

Guests are responsible for informing Travel With Mich and/or the activity operator of any pregnancy prior to participation.

If a guest is discovered to be pregnant at the activity location, the operator reserves the right to deny or remove participation from the activity for safety reasons.

No refunds will be issued for failure to disclose pregnancy restrictions prior to booking or participation.

Participation restrictions may vary depending on the operator, activity type, and safety regulations.

14. GUEST CONDUCT & RIGHT TO REFUSE SERVICE

Travel With Mich reserves the right to refuse or terminate service without refund to guests who:
– display abusive behavior
– engage in illegal activity
– are excessively intoxicated
– threaten staff or other guests
– damage property
– violate safety rules

Guests are expected to behave respectfully toward:
– drivers
– tour guides
– staff
– locals
– fellow travelers

EQUIPMENT & PROPERTY DAMAGE

Guests agree to use all equipment, vehicles, and property responsibly.

Any loss or damage caused by negligence, misuse, reckless behavior, or failure to follow instructions may result in financial responsibility, including repair or replacement costs as determined by Travel With Mich or its partners.

15. PERSONAL BELONGINGS

Guests are responsible for safeguarding their personal belongings at all times.

Travel With Mich is not responsible for lost, stolen, or damaged items.

16. PHOTO & VIDEO CONSENT

Photos and videos captured during tours or experiences may be used for:
– social media
– marketing
– promotional materials
– website content

unless the guest submits a written request opting out prior to service.

17. WEBSITE USE

All content, branding, logos, photos, videos, and materials displayed on this website are property of Travel With Mich and may not be copied, reproduced, or distributed without permission.

18. GOVERNING LAW

These Terms & Conditions shall be governed and interpreted under the laws of Jamaica.

19. SEVERABILITY

If any provision within these Terms & Conditions is found to be invalid, unlawful, or unenforceable, the remaining provisions shall remain in full force and effect.

20. AGREEMENT

By booking with Travel With Mich, you confirm that you:
– have read these Terms & Conditions
– understand the risks involved
– voluntarily agree to all policies stated above
– accept responsibility for all participants included in your reservation
